1. Acceptance of Terms

By accessing or using PillScanner ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you are at least 18 years of age.

2. Description of Service

PillScanner is an educational harm reduction tool that provides:

• Visual similarity matching against a database of laboratory-tested substances
• Access to publicly available lab report data
• Educational information about harm reduction

The Service does NOT:

• Perform chemical analysis or identification
• Guarantee the safety or composition of any substance
• Replace professional chemical testing
• Provide medical or pharmaceutical advice
• Encourage or condone illegal drug use

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability of information
• Safety of identified substances

We do not warrant that the Service will be uninterrupted, secure, or error-free.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PILLSCANNER, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Personal injury or death resulting from your use of the Service
• Any damages arising from reliance on information provided by the Service
• Any damages resulting from unauthorized access to or use of our servers

6. Indemnification

You agree to indemnify, defend, and hold harmless PillScanner and its affiliates, officers, directors, employees, consultants, and agents from any and all claims, liability, damages, losses, costs, expenses, fees (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any law or rights of any third party
• Any actions taken based on information from the Service

7. Prohibited Uses

You agree NOT to use the Service to:

• Violate any local, state, national, or international law
• Promote illegal drug use or trafficking
• Harm minors in any way
• Transmit malware, viruses, or malicious code
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any portion of the Service
• Collect or store personal data about other users
• Use the Service for any commercial purposes without permission
• Make medical or safety decisions without proper chemical testing

8. Intellectual Property

The Service and its original content (excluding user-provided content and public lab data) are and will remain the property of PillScanner. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used without our prior written permission.

The laboratory test data displayed comes from publicly available sources and remains the property of the respective testing organizations.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Modifications to Service and Terms

We reserve the right to:

• Modify or discontinue the Service at any time without notice
• Update these Terms at any time
• Refuse service to anyone for any reason

Continued use of the Service after changes constitutes acceptance of the modified Terms.

11. Termination

We may terminate or suspend access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Service operates, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located within that jurisdiction.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

14. Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and PillScanner regarding the use of the Service, superseding any prior agreements.

• Never use alone when testing unknown substances
• Start with small doses if testing is not available
• Keep naloxone (Narcan) available
• Seek help from harm reduction organizations
